1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the Adfure platform and website at adfure.com (the “Service”), operated by Ecom Vision Ltd (“Adfure”, “we”, “us” or “our”). By creating an account or using the Service, you agree to these Terms.
2. Description of the Service
Adfure is a multi-tenant, AI-powered advertising-management platform. It connects to your own advertising accounts (Meta, Google, TikTok, LinkedIn) and analytics accounts (Google Analytics 4) with your permission, and provides audits, insights, monitoring and optimization recommendations for your advertising campaigns. Where you authorize it, the Service can also help you manage and adjust campaigns.
3. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for providing accurate account information, for keeping your login credentials secure, and for all activity that occurs under your account. You must have the necessary rights and authorization to connect any advertising or analytics account to the Service.
4. Subscriptions and billing
The Service is offered on a subscription basis. Payments are processed securely by Stripe; we do not see or store your card details. By subscribing, you authorize us (through Stripe) to charge the applicable fees on a recurring basis until you cancel. You can cancel your subscription at any time; cancellation takes effect at the end of your current billing period, and fees already paid are non-refundable except where required by law.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Violate the terms or policies of any connected third-party platform (such as Meta or Google).
- Attempt to gain unauthorized access to the Service, other users’ data, or our systems.
- Interfere with, disrupt, or overload the Service or its infrastructure.
- Reverse engineer, resell, or misuse the Service except as expressly permitted.
6. Your data and account ownership
You retain full ownership of your advertising accounts, analytics accounts, and all data within them. Connecting an account to Adfure does not transfer ownership to us. We access your data only to provide the Service, as described in our Privacy Policy. You can disconnect any account or delete your data at any time; see our Data Deletion Instructions.
7. Intellectual property
The Service, including its software, design, and content (excluding your data), is owned by Ecom Vision Ltd and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, or create derivative works of the Service.
8. Third-party platforms
The Service integrates with third-party platforms such as Meta, Google, TikTok, LinkedIn, Google Analytics 4, Stripe and Stape. Your use of those platforms is subject to their own terms and policies. We are not responsible for the availability, changes, or actions of any third-party platform, and integrations may change or become unavailable if a platform changes its API or terms.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. Advertising results vary and depend on many factors outside our control. We do not guarantee any specific advertising outcomes, revenue, or return on ad spend. Recommendations provided by the Service are informational and you are responsible for decisions you make. Any specific guarantee we may offer (such as our “Leak Guarantee”) is governed by its own separate written terms and is not part of these general disclaimers.
10. Limitation of liability
To the maximum extent permitted by law, Ecom Vision Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
11. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends, and we will handle your data in accordance with our Privacy Policy and Data Deletion Instructions.
12. Governing law
These Terms are governed by the laws of Bulgaria and applicable European Union law. Any disputes shall be subject to the competent courts of Bulgaria, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
